1. About This Policy

EmpireTix ("EmpireTix," "we," "us," or "our") is a ticket brokerage based in New Jersey. We help customers buy and sell tickets to sports, concert, theater, and other live events. This Privacy Policy describes how we collect, use, share, and protect information when you visit empiretix.com, sign up for our email list, contact us, or otherwise interact with our services (collectively, the "Services").

By using our Services, you agree to the practices described in this Policy. If you do not agree, please do not use the Services.

6. Marketing Communications

A. Email

If you provide your email address through our signup form or another submission, we may send you marketing emails about EmpireTix events, offers, and updates. Every marketing email we send includes an unsubscribe link. You may also opt out by emailing privacy@empiretix.com.

Transactional emails (order confirmations, delivery notices, customer-service responses, payment receipts, account or security notices) may be sent even if you have opted out of marketing emails, because they are necessary for the operation of the Services.

B. SMS & Text Message Program (TCPA Notice)

EmpireTix operates an SMS messaging program in accordance with the federal Telephone Consumer Protection Act ("TCPA"), 47 U.S.C. § 227, and applicable FCC and state regulations.

Consent. By providing your mobile phone number to EmpireTix — through our website, a written form, by checking an opt-in box, replying to a sign-up message, or by giving the number to a customer-service representative — you expressly consent to receive recurring autodialed and pre-recorded text messages from EmpireTix at that number, including marketing, promotional, account, transactional, customer-service, and informational messages. Your consent is not a condition of any purchase.

Types of messages you may receive.

Message frequency. Message frequency varies based on your interactions with EmpireTix (such as orders placed, events you've expressed interest in, and ongoing campaigns). You may receive up to multiple messages per week.

Message and data rates. Message and data rates may apply. EmpireTix does not charge for the messages themselves, but standard message and data rates from your mobile carrier may apply to every message sent or received. Check with your carrier if you have questions about your plan.

How to opt out (STOP). You can cancel the SMS program at any time. Reply STOP to any text message we send. After replying STOP, you will receive one confirmation message that you have been unsubscribed, after which we will not send you further SMS messages. If you want to rejoin, sign up again or reply UNSTOP.

How to get help (HELP). Reply HELP to any text for assistance, or contact us at support@empiretix.com.

Supported carriers. Our SMS program is available on most US wireless carriers, including AT&T, T-Mobile, Verizon Wireless, Sprint, Boost, Cricket, MetroPCS, U.S. Cellular, and others. Carriers are not liable for delayed or undelivered messages. Delivery of messages is subject to effective transmission from your carrier and is not guaranteed.

Privacy. EmpireTix does not sell, rent, or share your mobile phone number with third parties for their marketing purposes. We share your number only with service providers acting on our behalf to deliver messages, prevent fraud, comply with law, or operate the Services, as described in Section 4 of this Policy. Information you provide via SMS will be treated as described in this Privacy Policy.

Eligibility. Our SMS program is open to mobile-phone subscribers in the United States who are at least 18 years old (or who have parental/legal-guardian consent). By participating, you represent that you are the account holder for the phone number you provide, or that you have the account holder's permission to enroll the number.

Changes to the program. EmpireTix reserves the right to change or terminate the SMS program at any time without notice. We will not, however, send messages to a number that has opted out unless and until you re-subscribe.

If you believe you have received an SMS from us in error or without your consent, please contact privacy@empiretix.com immediately and we will investigate and remove your number if confirmed.

7. Data Security

We use commercially reasonable administrative, technical, and physical safeguards to protect personal information. Our website uses TLS encryption (HTTPS), and we limit access to personal information to personnel and service providers who need it to perform their duties. Payment-card information is handled directly by our PCI-DSS compliant payment processor and is not stored on our servers.

No method of transmission or storage is 100% secure, however, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.

8. Data Retention

We retain personal information for as long as necessary to provide the Services, fulfill the purposes described in this Policy, comply with legal obligations, resolve disputes, and enforce our agreements. When personal information is no longer needed, we will delete or anonymize it.

Before final launch, this document should be reviewed and customized by qualified legal counsel — particularly with respect to the New Jersey Ticket Resale Act (N.J.S.A. 56:8-26 et seq.) and any state-specific consumer-disclosure requirements applicable to your customer base.
